The advisory report of the Modernization Commission, led by Congresswoman Paola Martínez (Popular Renewal), concluded to partially grant the delegation of powers to the Executive to legislate for 120 days. The group analyzed 14 subtopics of administrative simplification and structural reform of the State.

In the document, accessed by El Comercio, the working group declared that four subtopics were viable, four others unviable, and one partially viable. At the same time, it indicated that five did not fall within the scope of competence of the working group.

The working group determined that the subtopic seeking to modify the regulatory framework regarding administrative procedures, as well as to enact measures for administrative simplification and improve the provision of services by public entities, should be declared viable.
“The proposed plan is viable, as it substantially aligns with the mandate of administrative simplification established in the TUO of Law No. 27444 (General Administrative Procedure Law – LPAG), the State policy on digital transformation, and the Single Procedure System (SUT) regulated by Supreme Decree No. 031-2018-PCM,” the document states.
The working group also expressed support for legislating on digital transformation, digital security in the public and private sectors, as well as the digitization of State activities and services.
Similarly, it considered it viable to modify the definition of “bureaucratic barriers.”
It also determined the viability of strengthening the regime applicable to processing fees of public entities.
—Unviability—
Subsequently, the working commission concluded that it is not viable to modify the regime of precautionary measures with the aim of granting them greater effectiveness.
The same position was taken regarding the proposal to modify the regime of mandates contained in resolutions that conclude procedures.
It also found no viability in modifying the regulatory framework on improving regulatory quality to consolidate the application of these instruments in the Judiciary.
Finally, it opposed legislating on the structural reform of the State within the scope of the Executive Branch.
