The information request was made after El Comercio revealed that the Ombudsman requested the Supreme Court to explain the delay in an annulment appeal filed by the former parliamentarian of Perú Libre (PL).
According to the official letter, the anti-terrorism prosecutor, Milko Ruiz, seeks to determine whether there was an explicit request from the convicted former parliamentarian or if it was the Ombudsman’s initiative.
Additionally, the Anti-Terrorism Prosecutor’s Office requested the Public Ministry (MP) that the supreme prosecutor in charge of the Bermejo Case participate in the appeal hearing on October 2.
Bermejo Rojas was sentenced in October 2025 to 15 years in prison. He filed an annulment appeal which was elevated to the supreme instance in January 2026.
On September 1, the supreme court scheduled the appeal hearing for October 2.

However, on September 8, through the Office of the Program for Persons Deprived of Liberty, the Ombudsman requested the Permanent Criminal Supreme Chamber to provide an account of the procedural itinerary of the appeal filed by Bermejo Rojas and to “detail the reasons that may have caused the delay in processing this case.”
It should be noted that previously, the Supreme Chamber had already informed the convicted former congressman that according to the Organic Law of the Judiciary, cases are handled “in strict order of entry.”

What does the document sent to the Ombudsman say?
In response, through Official Letter No. 0499-2026-JUS/PGE-PDET dated September 15, the Anti-Terrorism prosecutor, Milko Ruiz, requested that the Ombudsman, Josué Gutiérrez, order the corresponding official to send a report specifying whether the convicted Guillermo Bermejo had initiated any procedure before that institution.
“Please arrange for the appropriate person to inform this Prosecutor’s Office if the person convicted of terrorism, Guillermo Bermejo Rojas, has filed any complaint or denunciation with your institution or has requested the initiation of any procedure.”

According to the document accessed by this newspaper, the Anti-Terrorism Prosecutor’s Office specified that if the answer is affirmative, the Ombudsman should send copies of the documents supporting the request, inform about its nature, and the procedure that justified the initiation of the process within that institution.
The mentioned prosecutor’s office based its request, among others, on paragraph 2 of article 33 of Legislative Decree No. 1326, which establishes that it is the function of public prosecutors to request from any public entity the information and documents necessary to evaluate the initiation of legal actions or to exercise an adequate defense of the State.
Along with this, the Anti-Terrorism Prosecutor’s Office also requested accreditation as a party before the Supreme Court in order to participate in the appeal hearing filed by Bermejo Rojas.

Prosecutor’s presence requested at appeal hearing
On the other hand, through Official Letter No. 500-2026-JUS/PGE-PPEDT (SMC), the Anti-Terrorism prosecutor, Milko Ruiz, notified the Public Ministry (MP) of the summons for the oral appeal hearing and requested the prosecutor’s attendance in the Bermejo Rojas Case.
The document dated September 15 was sent to Supreme Prosecutor Gilmer Robinson Jara Vergara of the First Supreme Criminal Prosecutor’s Office.
In it, the prosecutor’s office emphasizes that the hearing scheduled for October 2 is due to the appeals filed by the defense of the convicted Guillermo Bermejo Rojas against the sentence dated October 24, 2025, issued by the Third National Criminal Appeals Chamber of the National Specialized Criminal Justice Superior Court in file No. 59-2015-0, which convicted the former parliamentarian.
Although the supreme prosecutor submitted Supreme Opinion No. 155-2026 to the Supreme Court, recommending that the sentence not be annulled, the prosecutor’s office argued that since it is an “emblematic” case, the prosecutor’s presence on the day of the hearing is necessary.
“On the other hand, since your office has issued Supreme Opinion No. 155-2026, in which it has expressed that the appealed sentence should not be annulled, I request that a representative of your prosecutor’s office be appointed to participate in the scheduled hearing, considering that this is a criminal case against former congressman Guillermo Bermejo Rojas and it is an emblematic and nationally significant criminal case,” the prosecutor requested.

Why was Guillermo Bermejo sentenced?
According to the sentence issued by the Third National Superior Criminal Liquidating Chamber, former congressman Guillermo Bermejo allegedly joined the ranks of the terrorist organization Shining Path (SL) between 2008 and 2009.
Bermejo, the court indicated, was a collaborator of the terrorist ranks and was known as comrade ‘Che’.
According to the ruling, Bermejo Rojas “consciously and voluntarily” attended terrorist camps located in the jungle of the Ene, Apurímac, and Mantaro Valleys (Vraem).
In these incursions, the sentence states, Bermejo Rojas held meetings with terrorist leaders Víctor Quispe Palomino, alias comrade ‘José’, and Jorge Quispe Palomino, alias comrade ‘Raúl’.
Additionally, he allegedly received training and indoctrination. He was also reportedly responsible for transporting information and documents of the terrorist organization Shining Path to foreign terrorist groups.
If the Supreme Court confirms the sentence imposed on Bermejo Rojas, he will serve his sentence until 2042.
He is currently serving the sentence at the Ancón I Prison.
Bermejo Rojas faces other proceedings also related to alleged links to terrorism and obstruction of justice.
He became a congressman for the Perú Libre (PL) party, which admitted him into its ranks, despite Bermejo Rojas having been detained in 2015 for his alleged links to terrorism.
