The defense of the imprisoned Jair Bolsonaro denied this Wednesday that the former president of Brazil authorized a video created with artificial intelligence in which he supports the candidacy of his eldest son, Flávio Bolsonaro, in the October presidential elections.

The Supreme Court had requested explanations about the use of that “deepfake” from the far-right former president (2019-2022), as it could be a possible violation of the ban that the court itself imposed on him to speak publicly, on social media or through third parties.

On Saturday, during the party convention where Flávio Bolsonaro launched his presidential bid, a “deepfake” of the 71-year-old former president appeared on screen.
“This is a simulation of my image and my voice made with artificial intelligence. As everyone here knows, I am imprisoned and silent due to an unjust decision,” said the digital replica of the main leader of the Brazilian right.
“I ask you to warmly welcome the person I chose to replace me, blood of my blood, my son Flávio,” continued the video projected at the Liberal Party convention.
The former president’s lawyers stated that Jair Bolsonaro “did not authorize” that creation.
The court had warned that authorizing the video would be a “serious transgression” of the conditions imposed by the court for the former president to return home after several months in jail.

The supreme court also warned that Flávio Bolsonaro could have violated Brazilian electoral law, which prohibits creating “deepfakes” of public figures to deliver political messages.
By using his father’s image, the candidate could have led voters to believe that Jair Bolsonaro is participating in his campaign, which would be an “obvious example of electoral disinformation through synthetic content,” according to the court.
Bolsonaro has four sons who “have always used his public image in the realm of political-party activity” without any opposition from their father, the former president’s lawyers recalled.

In March, magistrate Alexandre de Moraes granted Jair Bolsonaro humanitarian house arrest for health reasons.
However, the former president must comply with a series of restrictions such as refraining from using social media, cell phones, or making public statements.
The leftist president, Luiz Inácio Lula da Silva, will seek a fourth term in the October elections, and polls give him an advantage over his main rival, Flávio Bolsonaro.
