Ethics Committee initiates preliminary investigation against Deputy Julián Pérez: what happens next?

The Ethics Committee of the Chamber of Deputies opened a preliminary inquiry against Congressman Julián Pérez Mallqui, from Juntos por el Perú, for alleged physical and psychological aggression against his ex-partner. This was announced by the chairman of that working group, Henry Albañil, from the Civic Works Party, this Wednesday, August 19, during the committee’s first ordinary session.

The Ethics chairman added that Pérez has already been notified of the complaint against him, filed by Deputy Christian Aranda, from Renovación Popular.

As explained during the session, the system for receiving complaints and other documents by the committee is just now “being enabled.” Therefore, arrangements were made with the Major Office of the Congress to send the complaint in physical form.

The committee was established last Friday after a series of delays that kept its formation in suspense. That day, Albañil assured that they would prioritize the mentioned case.

Deputy Pérez was detained at the San Miguel police station on Thursday, July 30 after being reported by his ex-partner. He recently stated that he will cooperate with the investigations in the Ethics Committee.

“I will submit myself to the Parliament’s Ethics Committee and will cooperate with all investigations because I am the first interested party in clarifying this,” he said in an interview with RPP on August 14.

Process

Through the preliminary inquiry, the Ethics Committee will determine whether the reported facts constitute a violation of parliamentary ethics and if there are indications or sufficient elements to start an investigation.

Then, the committee may order the start of the investigation with a simple majority vote of its members. If so, Pérez will have five days to present his defense and will be summoned to a hearing to be questioned.

If the committee determines that Pérez violated the Parliamentary Code of Ethics, it may propose to the full Chamber of Deputies his suspension for up to 120 days. However, among other less severe sanctions are public recommendation, public written reprimand, and public written reprimand with a fine.

The Supreme Family Prosecutor’s Office is investigating Pérez for the same case, for the alleged crime of aggression against women or family members. Therefore, it has ordered more than 10 procedures to verify the aggression. Among these, a psychological evaluation of the legislator.

Cipriani also announced that he is preparing a complaint against Deputy Catherin Palomino, from Juntos por el Perú, for alleged violation of the ethical conduct duties of Congress. This is due to alleged acts of intimidation against relatives of former President Pedro Castillo through WhatsApp messages.

The deputy questioned that Palomino chairs the Justice and Human Rights Committee despite the accusations against her.
