The decision was adopted after the electoral body invalidated the credential previously granted to Rafael López Aliaga, who communicated his decision not to join the Senate. The resolution was issued on July 20, thus concluding the procedure to accredit the new representative.

In its resolution, the highest electoral body indicated that the measure is based on Article 11 of the Congress Regulations, which establishes the stages that must be completed for a legislator to fully acquire their status as a parliamentarian.

The JNE recalled that the proclamation of results and the delivery of credentials are not sufficient by themselves to consolidate the congressional mandate. For this, it indicated, three phases must be completed: the proclamation of the elected candidate, their incorporation into Parliament, and the respective swearing-in.

In this context, it specified that, since the swearing-in of Rafael López Aliaga had not occurred, his status as senator did not become legally perfected, which allowed his credential to be invalidated and Absalón Vásquez Villanueva to be accredited in his place.
